AGENDA ITEM 7D <br />• STAFF ORIGINATOR: John Powell <br />COUNCIL MEETING DATE: January 8, 2001 <br />• <br />• <br />TOPIC: SECOND READING, Ordinance No. 17 -00, Vacating a portion of <br />the Lois Lane right -of -way dedicated as part of the Mar Don Acres plat (at 7870 <br />Country Lane). <br />VOTE REQUIRED: 415th VOTE REQUIRED <br />BACKGROUND: <br />Mr. Barry Przybylski of 7870 Country Lane has requested vacation of the street <br />right -of -way located at the northeast corner of his property. The right -of -way to <br />be vacated is that portion which was to accommodate construction of a cul -de- <br />sac. This right -of -way was secured as a part of the Mar Don Acres plat in 1978 <br />and is no longer necessary due to the recently developed Highland Meadows <br />West Plat. Lois Lane now continues to the east of Mr. Przybylski's property and <br />the cul -de -sac will not be needed. <br />Staff has published the vacation in the legal newspaper and the City Council has <br />held the Public Hearing and approved the first reading of the Ordinance on <br />December 11, 2000. Mr. Przybylski is the only affected property owner. In our <br />review of the request we see no reason to keep this right -of -way due to the newly <br />constructed extension of Lois Lane. We recommend approval of the Second <br />Reading of Ordinance No. 17 -00. <br />OPTIONS: <br />1. Approve the Second Reading and Adoption of Ordinance 17 -00 <br />2. Return to staff for further consideration <br />RECOMMENDATION: <br />Option No. 1 <br />
