The property in question shall be zoned R -1 or R -1X or a rezoning application be in process in <br />conjunction with the preliminary plat. <br />The rezoning request is occurring concurrently with the MUSA request. <br />3. The property in question must be immediately adjacent to existing MUSA. <br />MUSA is directly across both Mustang and Palomino Lanes. <br />4. MUSA Reserve shall be allocated to net buildable acres. <br />The net acreage for the nine lots is 2.55 acres, and that is the MUSA request. <br />5. Development of the property must be considered a natural utility extension. <br />6. Development of the property must be considered a natural extension of existing roadways. <br />Utilities and roadways exist directly adjacent to the site. <br />7. Development of the property shall not adversely affect the health, welfare, and general <br />safety of the community. <br />8. Development of the property shall be environmentally compatible with the surrounding <br />area. <br />There is no evidence of negative impacts to the community or environment. The wetland plan <br />was approved by the Rice Creek Watershed District. <br />9. Development of the property shall be consistent with the City's Comprehensive Park Plan. <br />The revenue from developing the site into nine lots will provide funds to develop the park <br />according to the Park Plan. <br />10. MUSA Reserve shall be allocated only to properties located within Sewer District 1, 4s, 6 <br />and the Behm's Century Farms Development within Sewer District No.2. <br />The site is almost entirely within the Behm's development as reviewed by the Met Council, <br />and would be completely in it if not for a past oversight. <br />11. Development of the property shall be consistent with the City's comprehensive Sewer and <br />Water Plan. <br />Utilities and roadways exist directly adjacent to the site. <br />12. The developer shall demonstrate a commitment to the community. - <br />This is one phase of the larger Behm's development area. <br />
