• <br />Cartier Variance <br />page 2 <br />Findings for Variance <br />In considering all requests for variance and in taking subsequent action, the City shall make a <br />finding of fact: <br />1. That the property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />2. That the plight of the landowners is due to physical circumstances unique to his property not <br />created by the land owner. <br />3. That the hardship is not due to economic considerations alone and when a reasonable use for <br />the property exists under the terms of the ordinance. <br />4. That granting the variance requested will not confer on the applicant any special privilege <br />that would be denied by this ordinance to other lands, structures, or buildings in the same <br />district. <br />5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. <br />The location of the low, wet area prevents an accessory building from being built to the southeast <br />of the house. The existing drainfield and need for a secondary drainfield area prevents the <br />building from being built to the southwest of the house. It would be unreasonable to require a <br />driveway through the wet area to reach the far southeast corner of the property. The landowner's <br />intent to use the new building for an agricultural use fits with the purpose of the Rural zoning <br />district. <br />• Staff recommends approving the variance with the following condition: <br />1. A building permit must be obtained before construction of the accessory building <br />begins. <br />PLANNING & ZONING BOARD ACTION <br />The P & Z approved the variance request at its May 9, 2001 meeting. <br />OPTIONS <br />1. Approve Resolution 01 -69 granting the variance as requested with the condition listed. <br />2. Deny the variance request. <br />3. Return to staff with direction. <br />RECOMMENDATION <br />• Option 1 <br />
