will be accepted for park dedication. The balance of the dedication will be cash in lieu of land. <br />The amount to be paid will be based upon the rates in effect at the time of final plat. <br />Wetlands: There are 15.34 acres of wetland on the property. Some fill is proposed to <br />accommodate roadway construction. The proposal is to mitigate the fill adjacent to other <br />wetland areas. The wetland delineation and proposed fill are subject to the review and <br />permitting of Rice Creek Watershed District, which oversees the Wetland Conservation Act <br />(WCA). It is the City staffs policy to require preliminary approval (tabled with approval for <br />administration action or TWAFAA) from Rice Creek before the City staff recommends approval <br />by the Planning and Zoning Board. This has been completed as of April 25, 2001. <br />Environmental Board: The Environmental Board reviewed the application and they <br />recommended that the tree preservation be better well defined, raised concern regarding 70 <br />houses being platted and relationship to the total lots platted in the community, request to reduce <br />the lot areas in Block 2 so the area could be included in the greenway. <br />Tree Preservation: There are woods identified on the site and much of the tree area is being <br />.preserved outside of the grading area. <br />Recommendation: The Planning and Zoning Board reviewed the application and they <br />recommend denial of the application in its entirety. The Board did not provide specific reasons <br />for their action although their discussion included concerns regarding availability of MUSA and <br />provisions for utility service in the area. <br />Staff has outlined two options for Council consideration. <br />Options: <br />A. Approve the comprehensive plan amendment, rezoning, and preliminary plat with <br />the following conditions: <br />1. Lot 6, Block 2 shall be 80' in width <br />2. All Engineering issues as outlined in the memo dated May 1, 2001 shall be <br />addressed. <br />3. Park dedication shall be paid prior to recording the final plat. <br />4. Right -of -way acquisition shall be completed prior to recording the final plat. <br />5. Wetland Markers shall be installed along the perimeter of the delineated <br />wetlands. <br />By adoption of the attached resolutions and ordinance <br />OR <br />B.
