(b) For plats that consist solely of individual single family residential lots, final plat applications for subsequent phases shall not be approved until building permits have been issued for 40% of lots in the preceding phase. This division applies only when the preceding phase consists of 40 or more lots. NA. This is the first phase of the development. (c) City attorney approval of the status of title/property ownership related to the final plat. The City Attorney is reviewing the status of the title/property ownership related to the final plat. (d) Completed development contract. A Development Agreement has been completed and shall be executed. (e) Conditions attached to approval of the preliminary plat shall be fulfilled or secured by the development agreement, as appropriate; and The conditions of the preliminary plat have been substantially fulfilled. Securities will be required with a Development Agreement. (f) All fees, charges and escrow related to the preliminary or final plat shall be paid in full. All fees, charges and escrow related to the preliminary or final plat shall be paid in full prior to release of the final plat mylars. BE IT FURTHER RESOLVED the Peltier Ponds PUD Final Plan/Final Plat is approved subject to the following conditions: 1. Resolution No. 26-06 approving the Peltier Ponds PUD Preliminary Plan/Preliminary Plat is in effect. 2. The Developer will enter into a Development Agreement with the City. 3. A Homeowners Association shall own and maintain the outlots containing private streets, open space, wetlands, buffers, and townhome open space. 4. A Homeowners Association shall maintain the landscaped street medians, mowed turf trail on Outlot G, and stormwater re -use system. 5. A trail easement shall be recorded over the paved and mowed/turf trails and corridors after the trails have been constructed. 6. Wetland buffer declarations shall be recorded over the open space, wetlands, and buffers.
