• <br />• <br />• <br />Member <br />adoption: <br />introduced the following resolution and moved its <br />LINO LAKES CITY COUNCIL <br />RESOLUTION 01 -172 <br />EMINENT DOMAIN RESOLUTION FOR BIRCH PARK TRAIL <br />WHEREAS, Birch Park has been designated to serve as the neighborhood park <br />for residents in the developments of Trapper's Crossing, Gemini Estates, <br />Peregrine Pass, and Royal Pines; and <br />WHEREAS, the City of Lino Lakes has attempted to secure a trail connection <br />from the Trapper's Crossing Development to Birch Park since 1994; and <br />WHEREAS, Lino Lakes has been unable to successfully negotiate acquiring two <br />acres of land for this important trail connection. <br />NOW THEREFORE BE IT RESOLVED, That the City Council hereby authorizes <br />the acquisition of land by Eminent Domain and to take title and possession of <br />that land prior to the filing of an award by the court appointed commissioner, <br />pursuant to Minnesota Statutes No. 117; and <br />BE IT FURTHER RESOLVED, that the City Attorney is requested to file the <br />necessary Petitioner therefor, and to prosecute such action to a successful <br />conclusion or until it is abandoned, dismissed, or terminated by the City or the <br />Court. <br />Adopted by the Lino Lakes City Council this 17th day of December, 2001. <br />ATTEST: <br />Ann Blair, City Clerk <br />John J.
