MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 7D <br />Jeff Smyser <br />February 9, 2004 <br />Resolution 04 -18: Approving <br />• Allocation of 2.24 Acres Commercial MUSA <br />• Amendment to Conditional Use Permit For Private Club <br />• Variance for Setbacks <br />Circle -Lex VFW, 7868 Lake Drive <br />VOTE: 3/5 for MUSA, 3/5 for CUP, 3/5 for Variance <br />(combined into one resolution) <br />BACKGROUND <br />The Circle -Lex VFW Post 6583 is interested in constructing a new building at their site <br />on the northeast corner of Lake Drive and Lois Lane. The site is not in the current <br />MUSA, but the City has ample MUSA reserve for commercial projects. The site has a <br />conditional use permit (CUP) which will need to be amended to allow the construction of <br />the new building. The required site and building plan review is an administrative review, <br />but the review elements are relevant to the CUP. <br />Because of the VFW's willingness to dedicate additional right of way, building and <br />parking drive setback variances are needed along Lake Drive. <br />The City approved a CUP amendment in April 1999 for an addition to the existing <br />building, which was never constructed.
