AGENDA ITEM 7 C
STAFF ORIGINATOR: Jeff Smyser
C. C. MEETING DATE: February 11, 2004
TOPIC: Resolution No. 04 -02
Allocation of MUSA Reserve Acres and Preliminary Plat
Justin's Preserve, White Pine Road
VOTE: 3/5
BACKGROUND
Carpenter Homes has requested approval of a preliminary plat for Justin's Preserve. Under the
current subdivision ordinance, the creation of new lots on city sanitary sewer requires a plat
rather than a minor subdivision. The project involves splitting an existing fourteen -acre parcel.
The plat includes a neighboring parcel. A portion of the land will be added to that neighbor's lot.
This application highlights an unusual situation that should be corrected. The existing house on
the large property, 171 White Pine Rd., is connected to city sanitary sewer and water. However,
it is not within the MUSA. It should have been included in MUSA when it connected to the
utilities. This also is the case with the existing 90' x 170' lot at 173 White Pine Rd (which is
being included in the plat). Neither of these properties is in the MUSA although both are
connected to utilities. This should be resolved now by allocating MUSA reserve. The area being
platted includes 4.4 acres of upland.
To accommodate the proposal, the following approvals are necessary:
1. Allocation of 3.7 acres of MUSA reserve
2. Preliminary plat
The P & Z Board reviewed a plat in December and recommended approval. The applicant then
reconfigured the plat and resubmitted it. In January, the P & Z recommended approval of the
second plat, which is before the City Council now.
ANALYSIS
The following is a summary of the of the proposal:
Gross Site Area 14.3 acres
Upland Area 4.4 (approximation)
Total Lots 3
Gross Density 0.21 units /acre
Net Density 0.68 units /acre
