• <br />Justin's Preserve <br />page 4 <br />conditional approval of the first plat application, which the P & Z Board saw in December. The <br />new plat, dated January 16, 2004, should be submitted to RCWD for re- examination. <br />Power Line Easement: There is an existing power line running along the southern edge of the <br />property. There was a blanket easement over the entire property. The applicant worked with the <br />power company to confine that easement. This will need confirmation for final platting. <br />ENVIRONMENTAL BOARD <br />The Environmental Board reviewed this application on January 28. Recommendations are <br />attached. <br />CONDITIONS OF APPROVAL <br />Approval of the project should include the following conditions: <br />1. Lot 1 shall connect to city sanitary sewer and water. <br />2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. <br />3. Park dedication of $1,665 shall be paid. <br />4. Prior to approval of the final plat by City Council, the applicant shall submit proof that the <br />powerline easement has been confined. <br />5. The new plat dated January 16, 2004, must obtain approval by the Rice Creek Watershed <br />District prior to final plat approval by the City Council. <br />OPTIONS. <br />1. Approve Resolution 04 -02, which includes approval of both the allocation of 3.7 acres of <br />2004 MUSA reserve and the preliminary plat, with conditions. <br />2. Return to staff with direction. <br />RECOMMENDATION <br />Option 1 <br />
