MEETING DATE: <br />TOPIC: <br />VOTE: <br />BACKGROUND <br />AGENDA ITEM 7 C <br />Jeff Smyser <br />March 22, 2004 <br />Resolution 04 -17 <br />• Conditional Use Permit For A Church In the <br />Rural Zoning District, and <br />• Preliminary Plat, Eagle Brook Addition <br />Eagle Brook Church <br />3/5 for Conditional Use Permit <br />3/5 for Preliminary Plat <br />(combined into one resolution) <br />Eagle Brook Church proposes to construct a new facility on 90+ acres on the west side of <br />20th Ave., about 1/4 mile north of 77th St. A church is a conditional use in the Rural <br />zoning district. The application also includes a preliminary plat. The proposed plat splits <br />the property into two lots. The existing house on the property would be on one lot. The <br />proposed church would be on another lot. <br />The required site and building plan review is an administrative review. Most of the <br />elements examined for a site plan are relevant to the conditional use permit, and so are <br />included in this report. The application includes the request for an increase in building <br />height that can be included in a conditional use permit. <br />The City processed an Environmental Assessment Worksheet (EAW) on this project in <br />2002 -2003. That review examined the potential environmental impacts of the project. <br />The design incorporated into the current application used information gathered during the <br />EAW process. <br />The P & Z opened the public hearing on the conditional use permit application at the <br />November 2003 meeting. That public hearing was continued. A number of issues were <br />unanswered, one of which was the existing house on the site. The church then submitted <br />an application for a preliminary plat to create a separate lot to allow the house to remain. <br />A preliminary plat requires a public hearing. New notices were published and mailed, <br />and the public hearing for the plat was opened at the December 2003 meeting. We then <br />combined the public hearings for the conditional use permit and the preliminary plat. <br />The P & Z made a recommendation at the January 2004 meeting. <br />
