B <br />Jeff Smyser <br />May 10, 2004 <br />Continued Public Hearing <br />First Reading of Ordinance No. 07 -04 <br />Vacating Ponding and Flowage Easement <br />125 Ash Street (Rice Creek Covenant Church) <br />The Rice Creek Covenant Church has submitted an application to further develop its current site <br />at 125 Ash Street. The application includes several elements. If the project proceeds, the <br />vacation of two ponding and flowage easements must occur. The City Council holds public <br />hearings for vacations. Because of advance publication requirements, the easement vacation <br />notice was published for April 12th. The public hearing was opened and continued to May 10th <br />because we anticipated the entire project would be considered tonight. However, we are <br />awaiting some important information on the design of the project, and have postponed it until the <br />May 24th meeting of the City Council. The entire project is scheduled to be considered that <br />night, and the easement vacation can be considered then. <br />RECOMMENDATION <br />Re -open the public hearing and continue it to May 24, 2004. <br />
