CITY OF LINO LAKES <br />ORDINANCE NO. 13-04 <br />ORDINANCE VACATING ROAD EASEMENT, <br />1390 KARTH ROAD <br />EQUITY ESTATES <br />WHEREAS, the City Council of Lino Lakes hereby vacates the 30' Road <br />Easement at 1390 Karth Road in Equity Estates, in its entirety, from its intersection with <br />Karth Road to the south property line of said parcel; and <br />WHEREAS, a public hearing was held on May 10, 2004 before the City Council <br />in the City Hall Council Chambers after due published and posted notice had been given <br />on April 20, 2004, and a reasonable attempt was made to give personal notice to all <br />affected property owners, and all persons interested were given an opportunity to be <br />heard; and <br />WHEREAS, it appears to be in the best interest of the City to vacate such road <br />easement; and <br />WHEREAS, four - fifths of all members of the City Council concur in this <br />ordinance. <br />NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: <br />Section 1. That the 30' Road Easement, as dedicated on the Plat of Equity Estates, <br />Anoka County, Minnesota, is hereby vacated. <br />Section 2. That any person,' corporation or city owning or controlling easements <br />contained upon the property vacated reserves the right to continue maintaining the same <br />or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove <br />or otherwise attend thereto. <br />Section 3. This Ordinance shall be in full force and effect from and after 30 days <br />following its passage and publication, in accordance with the City Charter. <br />Passed by the Lino Lakes City Council this 24th day of May, 2004. <br />John J.
