CITY OF LINO LAKES ORDINANCE NO. 13-04 ORDINANCE VACATING ROAD EASEMENT, 1390 KARTH ROAD EQUITY ESTATES WHEREAS, the City Council of Lino Lakes hereby vacates the 30' Road Easement at 1390 Karth Road in Equity Estates, in its entirety, from its intersection with Karth Road to the south property line of said parcel; and WHEREAS, a public hearing was held on May 10, 2004 before the City Council in the City Hall Council Chambers after due published and posted notice had been given on April 20, 2004, and a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and WHEREAS, it appears to be in the best interest of the City to vacate such road easement; and WHEREAS, four - fifths of all members of the City Council concur in this ordinance. NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: Section 1. That the 30' Road Easement, as dedicated on the Plat of Equity Estates, Anoka County, Minnesota, is hereby vacated. Section 2. That any person,' corporation or city owning or controlling easements contained upon the property vacated reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto. Section 3. This Ordinance shall be in full force and effect from and after 30 days following its passage and publication, in accordance with the City Charter.
