• <br />• <br />• <br />STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />ACTION REQUIRED: <br />BACKGROUND <br />AGENDA ITEM 6H <br />Michael Grochala <br />October 12, 2004 <br />Consideration of Resolution No. 04 -150 <br />Authorizing Transfer of Otter Lake Rd ROW to <br />Anoka County. <br />Simple Majority <br />In 1998 the City entered into a Joint Powers Agreement (JPA) with Anoka County to <br />construct the realigned Otter Lake Road through the Clearwater Creek Development <br />Center. As set forth in the JPA the City acquired the right -of -way and constructed the <br />project. Anoka County, in return, agreed to $678,348 in cost sharing for the project. <br />Additionally, under the terms of the agreement, upon completion of the project the new <br />alignment would be transferred to Anoka County and the old alignment (Otter Lake <br />Service Road) would be transferred to the city. <br />RECOMMENDATION <br />The City Attorney has drafted the necessary quitclaim deed to convey the right -of -way <br />to Anoka County. Since the right -of -way lies within a Charter Exempt area the City can <br />transfer the property by resolution. <br />Staff is recommending approval of Resolution No. 04 -150 <br />ATTACHMENTS <br />1.
