• <br />• <br />Development Contract — Site Grading and Bridge Only <br />Pheasant Hills Preserve 12th <br />MnDot requirements. The association documents shall also be written to <br />enable the City to enter and access the bridge for public purposes and/or <br />effect maintenance repairs as may be deemed necessary in the interest of <br />public safety, health, and welfare, and shall allow the City to assess said <br />maintenance and repair costs to the homeowners. <br />c) The Developer shall construct the bridge in accordance with the <br />requirements of the a permit from the Minnesota Department of Natural <br />Resources. <br />d) In addition to the bridge plans, the Developer shall conduct and provide <br />a pre - construction survey and monitoring program for noise and <br />vibration for both the bridge construction and entire site development <br />construction. The pre - construction survey and monitoring program must <br />be approved by the City prior to any grading or construction activity. A <br />temporary noise wall (subject to the approval of the City Engineer) must <br />be constructed around any pump or sound emitting device that will run <br />beyond day -time working hours. <br />e) Improvements to be constructed by the Developer, including the bridge <br />and site grading will utilize existing City streets for access. An existing <br />condition survey of Ruffed Grouse Terrace shall be conducted by the <br />City. In the event that damages to the street or other City infrastructure <br />result from said improvement work, the Developer shall be responsible <br />for effecting said repairs, or the City shall withhold escrows or deposits <br />as the City deems appropriate and necessary. <br />f) Homeowner's Association documents and legal covenants as required <br />shall be reviewed and approved by the City Attorney prior to the issuing <br />of any building permits. The homeowner's association documents shall <br />include a funding mechanism for maintaining of the bridge. <br />g) The Developer shall provide a financial security or cash escrow in an <br />amount of $ 750,000 to assure completion of the bridge or restoration of <br />the site in the event the bridge is not completed by the Developer. No <br />site grading or other work of any kind (except for bridge construction) <br />shall be allowed on the island until the bridge is completed. <br />6. No burning of vegetation cleared during construction shall be allowed. <br />7. The project shall not be final platted until 2005 to comply with growth <br />management policy. <br />
