•
•
AGENDA ITEM 1C
STAFF ORIGNINATOR: Jean Viger, Deputy Clerk
MEETING DATE: November 25, 2004
TOPIC: Consider Approving Application for Exempt
Permit, St. Joseph Catholic Church
VOTE REQUIRED: Simple Majority (3/5 Vote)
BACKGROUND:
St. Joseph Catholic Church has applied for an exempt permit to conduct a raffle at their
annual Venison Feed to be held on November 23, 2004. The proceeds from this
fundraising event will be used to award college scholarships to high school students from
the three school districts within the city. Non - profit organizations are allowed, under the
State Gambling Statutes, to apply for an exempt from gambling license if they conduct
fewer than five (5) gambling occasions per calendar year. St. Joseph Catholic Church
conducts fewer than five (5) per calendar and, therefore, remains exempt from requiring a
gambling license.
Minnesota Statute, Chapter 349, Section 349.166, Subd. 2, requires the non - profit
organization applying for the exemption permit to notify the city. The city must sign the
application acknowledging the request and state the action taken.
City policy requires a background investigation each time a permit or license application
is received. The Lino Lakes Police Department conducted an investigation and found no
reason to deny the application.
A copy of the application is on file in the city clerk's office.
OPTIONS:
1. Approve the application
2. Deny the application
RECOMMENDATION:
• Option No. 1
