When environmental review is required <br />and has not yet been completed, the MPCA will issue <br />a denial without prejudice. <br />If environmental review is required and has been <br />completed, the Agency will issue a waiver. This <br />change in procedure promotes better up -front <br />environmental planning by emphasizing the <br />importance of environmental review in the earlier <br />stages of the project planning process. Furthermore, <br />because the underlying 401 certification authority is <br />not changing, the MPCA will always reserve the right <br />to proceed differently if extreme or unique situations <br />merit a different approach. <br />Minn. Rules 7001.1420, regarding the issuance of 401 <br />certification, requires that determinations, including <br />waivers, must be made only in response to an <br />application for 401 certification. Therefore, formal <br />applications for 401 certification must still be sent to <br />the MPCA (care of Regional Environmental <br />Management Division, attn: 401 Certification) as they <br />have been in the past. For projects, this application <br />would consist of a completed copy of the Minnesota <br />Local/State /Federal Application Forms for <br />Water/Wetland Projects or the Minnesota <br />Local/State /Federal Application Forms for <br />Water/Wetland Projects - Public Transportation and <br />Linear Utility Projects (found on the Board of Water <br />and Soil Resources Web site, <br />www.bwsr. state. mn. us /programs /maior /prompt.html. <br />For more information <br />For more information about current reductions in <br />MPCA program service, please visit the MPCA's <br />Web site at www.pca.state.rnn.us /about /chances. <br />
