This <br />change in procedure promotes better up -front <br />environmental planning by emphasizing the <br />importance of environmental review in the earlier <br />stages of the project planning process. Furthermore, <br />because the underlying 401 certification authority is <br />not changing, the MPCA will always reserve the right <br />to proceed differently if extreme or unique situations <br />merit a different approach. <br />Minn. Rules 7001.1420, regarding the issuance of 401 <br />certification, requires that determinations, including <br />waivers, must be made only in response to an <br />application for 401 certification. Therefore, formal <br />applications for 401 certification must still be sent to <br />the MPCA (care of Regional Environmental <br />Management Division, attn: 401 Certification) as they <br />have been in the past.
