• <br />• <br />• <br />Resolution 07 -79 <br />Page 3 <br />NOW, THEREFORE, BE IT RESOLVED THAT the Lino Lakes City Council approves a <br />conditional use permit to allow earth material storage at 6644 20th avenue south. <br />BE IT FURTHER RESOLVED THAT the following conditions apply: <br />Conditions met by the applicant since the April 11, 2007 Planning and Zoning Board <br />Meeting <br />1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance <br />with Minnesota Pollution Control Agency (MPCA) requirements has <br />been prepared by the applicant. <br />2. The house foundation has been properly removed from the site. <br />3. The existing septic system has been abandoned according to City <br />requirements. <br />4. The site has been cleared of debris and other objects to provide a <br />safe situation for the proposed material hauling operation. <br />5. The site has fence and barricaded entrances to prevent the general <br />public from depositing garbage or refuse. <br />Staff recommends approval of the conditional use permit subject to the following <br />conditions of which some have been adjusted in response to the April 11 and May 9th <br />planning and zoning meetings: <br />1. Maximum slope on the pile shall be a 1 to 1 and in such condition <br />as not to be dangerous because of sliding or caving banks. <br />2. Limit any fill material to clean fill, defined as rock, sand, gravel, <br />clay, or other like and similar non - decomposable material. <br />Concrete, asphalt, metal, wood, and other debris shall be <br />prohibited. <br />3. A maximum amount of 7,000 cubic yards of material will be allowed <br />on the site at any time. A permanent berm located around the <br />stockpiled earth material will be required. <br />4. The maximum height of the stockpile material shall be 25 feet from <br />grade. <br />
