• <br />• <br />Molin Amendment <br />Page 5 of 6 <br />WHEREAS, the City Council of the City of Lino Lakes finds that, with the conditions of <br />approval included in this resolution, the following findings of fact apply as required by Section 2 <br />Subd. 2.B.7 and by Section 8 Subd.2.I.4 of the zoning ordinance. <br />a. This application is consistent with the comprehensive plan, including future and present <br />land uses. The building additions do not alter existing uses on the site. <br />b. The application meets all performance standards. <br />c. The project will not increase traffic generation or impacts. <br />d. The project will not increase demands on sanitary sewer and water use. <br />e. The project will not require capital improvements by the City. <br />f. The project will not create detrimental impacts. <br />g. The project will not impact natural or historic features. <br />h. All applicable Minnesota Pollution Control Agency requirements are satisfactorily met. <br />i. The project will not alter the site's drainage system previously approved by the City <br />Engineer. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lino Lakes City Council hereby approves an <br />amendment of the existing conditional use permit to allow the construction of an office building. <br />BE IT FURTHER RESOLVED that the following conditions apply: <br />1. All conditions in Resolutions 01 -182, Resolution 03 -73, Resolution 05 -13, and <br />Resolution 06 -32 continue to apply. <br />2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. <br />3. All conditions of the previous amendments shall continue to apply. <br />4. A Performance Agreement between the applicant and city must be executed prior to the <br />issuance of building permits for the site. <br />5. A photometric lighting plan in conformance with the standards of the zoning code must <br />be submitted prior to the issuance of building permits. All lighting fixtures will be <br />downcast shielded as required by the zoning code. <br />
