Memorandum - Schilling Consultant Services LLC <br />Date: May 25, 2007 <br />To: Ms. Stephanie McNamara, Administrator and Board of Directors <br />Vadnais Lake Area Water Management Organization (VLAWMO) <br />From: Joel G. Schilling, Principal <br />RE: VLAWMO Joint Powers Agreement - Amendments for Revenue Funding <br />Attached are the revised amendments to the VLAWMO Joint Powers Agreement adopted by motion at the May 24th <br />Board of Directors meeting. Specific changes from the May 18th draft document and incorporated within pages two <br />through 4 are as follows: <br />1. Deleted the word "Commission" and insert "Board" in Subdivision 24, paragraphs 1) and 6) and Subdivision 26. <br />2. Inserted $400,000 at the end of the first sentence of Subdivision 24, paragraph 3) reflecting the Total Maximum <br />Utility Charges for 2007. <br />3. The second sentence in Subdivision 24, paragraph 3) which begins "Thereafter, the Total .... Etc." pertaining to <br />the use of the Consumer Price Index (CPI) as an annual cost escalator for the Storm Water Utility was stricken. <br />The suggested JPA amendments relate primarily to authority for establishing a Storm Water Utility (a.k.a. Storm Sewer <br />Utility) and potential use of county levy authority for capital improvement projects, both in accordance with respective <br />Minnesota Statutes.
