• <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 8D <br />Gordon Heitke <br />July 9, 2007 <br />Ordinance No. 07 -07, Amending Chapter VIII of the Lino <br />Lakes City Charter, Regarding Public Improvements <br />and Special Assessments <br />VOTE REQUIRED: 3/5 (roll call vote required) <br />BACKGROUND <br />On February 12, 2007, the Lino Lakes City Council established a citizen's task force <br />for the purpose of studying the city charter provisions related to road reconstruction <br />improvements and report back to the City Council and the Lino Lakes Charter <br />Commission. The formation of the citizen's task force was prompted by public opinion <br />expressed through the recent community -wide survey and a community visioning <br />process. The 2030 Vision Plan recommended that a citizen -led task force be <br />• organized to identify options for a change to the charter. The City Council established <br />a task force comprised of interested citizens from the randomly selected 2030 <br />visioning group membership. <br />The Citizen's Task Force to Review Charter Provisions Pertaining to Local <br />Improvements has conducted study sessions, joint meetings with the Charter <br />Commission and City Council, and a public forum to gather information used in the <br />preparation of this report. Included in the report is a recommended amendment to <br />Chapter VIII of the Lino Lakes City Charter regarding public improvements. This <br />amendment was prepared by the Task Force with the assistance of Attorney Stephen <br />Bubul of Kennedy and Graven. <br />Minnesota Statutes provides for various methods of initiating amendments to a city <br />charter including initiation by the charter commission, city council and by citizens <br />through a petition. City council initiated proposed amendments need to be in the form <br />of an ordinance which is submitted to the charter commission for its review. The <br />charter commission shall approve or reject the proposed amendment or suggest a <br />substitute amendment within a prescribed time period. Following the charter <br />commission review, the council may submit the proposed amendment to the vote of <br />the people by placing it on the ballot. <br />
