STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 6F <br />Michael Grochala <br />July 23, 2007 <br />Accepting Quit Claim Deed (QCD) from Robert and <br />Joyce Moser. <br />Authorizing Execution of QCD to Robert and Joyce <br />Moser, Lake Dr /35W Interchange Improvements <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />In preparation for the Lake Drive /35W Interchange project the City acquired property <br />(house and land), located on the comer of Lake Drive and Marshan Lane, from Ms. <br />Elsie Rehbein,. As a part of this purchase, the City received a title insurance <br />commitment from Registered Abstracters, Inc., that indicates there may be vague and <br />ambiguous legal descriptions with possible gaps or overlaps between the property <br />purchased by the City and that of the adjacent property owner to the east (Moser). To <br />rectify this issue the City Attorney has recommended the exchange of deeds between <br />the City and the Moser's with revised and corrected legal descriptions. The Moser's <br />agreed to the exchange subject to the City providing a letter stating that the boundary <br />line as described in the deeds corresponds to the boundary stakes that are currently <br />existing along the property line. <br />The boundary stakes and legal descriptions have been verified by our surveyors from <br />SEH Inc., and the City Attorney has provided written confirmation to the Moser's as per <br />their request. Staff is now requesting council authorization for the Mayor and Clerk to <br />execute the Quit Claim Deed on behalf of the City and for the Council to accept the <br />QCD from the Moser's. <br />RECOMMENDATION: <br />Staff recommends approval of a motion to accept the QCD from the Moser's and to <br />authorize the Mayor and City Clerk to execute a QCD to the Moser's. <br />ATTACHMENTS <br />1.
