LIQUOR VIOLATIONS HEARING <br />• STAFF ORIGINATOR: Captain Kent Strege <br />HEARING DATE: September 10, 2007 <br />TOPIC: Liquor Compliance Checks & Violations <br />• <br />Liquor License Hearing - Background / Recommendation <br />On May 29, 2007 representatives of the Lino Lakes Police Department completed liquor <br />license compliance checks on all licensed establishments in Lino Lakes that were open at the <br />time. Two establishments failed the check, J &K Liquor as well as Bobby & Steve's <br />Utilizing the Best Practices Grid, the May 29th violation would be the second one in a 12 month <br />period for J &K Liquor (previous violation 6/23/2006) and thus would have a $1,000 civil <br />penalty as well as a 5 day suspension of their license which is recommended to be stayed. <br />On June 21st, 2007 Officers of the Lino Lakes Police Department found several patrons still <br />inside Miller's on Main after hours in violation of the liquor ordinance This is the first <br />violation for this establishment in the last 12 month period. In accordance with the Best <br />Practices Grid a $500 civil penalty is recommended. <br />The violation by Bobby & Steve's during this compliance check is their first violation and the <br />Best Practices Grid would institute a $500 civil penalty. Past practice has been that the first <br />historical violation of a liquor license be handled by providing training to their employees. <br />RECOMMENDATION <br />In summary the police department recommends that the following penalties be imposed as <br />defined in the grid: <br />J &K Liquor <br />$1,000 additional civil penalty as well as a five day license suspension (stayed) for the <br />second violation. <br />Miller's on Main <br />$500 civil penalty <br />Bobby & Steve's <br />Employee training <br />ATTACHMENT <br />Best Practices Grid <br />Section 701.10 of the City Code <br />
