Page 2 <br />Regulation of All- Terrain Vehicles <br />September 5, 2007 <br />Minn. Stat. § 84.928, Subd. 1 provides that a person may operate an all- terrain vehicle in <br />the ditch of the outside bank or slope of a county highway. The statute further provides that <br />after a public hearing, a county could restrict the use of an all- terrain vehicle in the ditch or <br />outside bank or slope of a county highway. <br />A county could adopt an ordinance prohibiting the use of all- terrain vehicles on the inside <br />bank or slope, the ditch, or the outside bank or slope of a county highway, after holding a public <br />hearing. Such an ordinance would essentially prohibit the use of all- terrain vehicles within the <br />county right -of -way except for a few statutory exceptions relating to agricultural purposes, the <br />use by an agent or employee of the road authority or the Department of Natural Resources <br />when performing or exercising official duties or powers. The County, however, could not adopt <br />a resolution or ordinance which specifically prohibits the use of all- terrain vehicles on county <br />highways within the City of Lino Lakes. Any such resolution or ordinance would have to cover <br />the entire County. <br />I hope the above information is helpful in responding to the City of Lino Lakes.
