• <br />• <br />AGENDA ITEM 8D <br />STAFF ORIGINATOR: Gordon Heitke <br />MEETING DATE: December 10, 2007 <br />TOPIC: Substitute Charter Amendment submitted <br />by the Lino Lakes Charter Commission <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />After receiving the report and recommendations of the Citizen's Task Force to Review <br />Charter Provisions Pertaining to Local Improvements in July 2007, the council acted to <br />refer a proposed charter amendment to Chapter VIII of the City Charter (Public <br />Improvements and Special Assessments) to the Lino Lakes Charter Commission. <br />This referral follows the process established by state statute for amendments <br />proposed by council (Minnesota Statutes, Section 410.12, Subd. 5). A charter <br />commission is allowed 60 days to approve, reject or submit a substitute amendment <br />with a 90 day extension period if requested. The commission exercised their right for <br />an extended review period thus making their response due back to the council by <br />December 6, 2007. <br />On November 30, 2007, the Lino Lakes Charter Commission submitted the attached <br />substitute charter amendment to City Hall. The amendment was delivered to the <br />Council and reviewed briefly at the council work session on December 3, 2007. <br />The council indicated that they will be further reviewing and discussing the proposed <br />substitute amendment during the first quarter of 2008. <br />The council also referred the proposed substitute amendment to the city attorney for <br />review and process recommendations <br />COUNCIL ACTION <br />The City Council is requested to officially accept the substitute charter amendment <br />submitted to the City on November 30, 2007. <br />ATTACHMENTS <br />Substitute Amendment to Chapter VIII recommended by the Charter Commission <br />
