• <br />1 <br />WORK SESSION ITEM 4 <br />STAFF ORIGINATOR: Paul Bengtson <br />CC WORK SESSION January 4, 2010 <br />TOPIC: Ordinance No. 14 -09 <br />Amending the Zoning Ordinance requirements for <br />Home Occupations /Home Extended Businesses, <br />Residential Parking, and Exterior Storage. <br />BACKGROUND <br />With the development of the 2030 Comprehensive Plan Update, it is appropriate <br />for the city to review its official controls. This is the first of many reviews of our <br />official controls. In this case, staff is attempting to clarify the existing regulations <br />in regards to Residential Parking and Exterior Storage. Additionally, at the <br />direction of the Planning and Zoning Board and City Council, staff has brought <br />forth draft language in regards to Home Occupations. <br />HOME OCCUPATION ANALYSIS <br />After a great deal of discussion at the staff level and with the Planning and <br />Zoning Board, the language forwarded to the City Council as part of this <br />ordinance creates a three tiered system to replace the existing two tier system. <br />Each tier allows a higher level of business activity. The first tier allows only <br />business activity inside the dwelling itself and no external customers or <br />employees at the site. The second tier allows expansion into accessory <br />structures and allows very limited external customers and /or employees. The <br />third tier allows certain properties (Larger than one acre, or zoned Rural or those <br />that front onto a major roadway) to have a higher level of activity <br />The Planning and Zoning Board were pretty evenly divided on two issues, though <br />ultimately they recommended 4 -3 to expand the hours of operations for the Tier 3 <br />home occupations and to eliminate a permit or associated fee from Tier 2. Staff <br />continues to recommend the requirement of a permit and fee for Tiers 2 and 3. <br />
