so
•
•
Planning & Zoning Board
October 14, 2009
Page 4
Mr. Laden made a MOTION to amend the restricted hours of operation under Tier C to
"Between the hours of 9 p.m. and 7 a.m. no customers or employees..." Motion was
supported by Mr. Root. Motion carried 4 -3. (Brady, Pogalz and Hyden voting nay.)
Staff explained that the reason for charging a permit fee for Tier B is to cover the
administrative time to verify the applicant address, confirm the requirements of the
proposed use, and enter the permit information into a database tracking system. A site
visit would require additional time by the city building official if necessary.
Mr. Laden asked if it would be possible to charge a fee only if a site visit is required.
Staff replied that they would have to establish a threshold for determining when a site
visit would be required. Mr. Tralle commented that a split in fees may create problems.
Mr. Nelson wondered why the city should even track home occupations falling under
Tier B. Staff replied that anytime a customer or employee enters a building they should
be assured of life- safety codes.
Mr. Nelson made a MOTION to remove the issuance of a permit and fee for Tier B.
Motion was supported by Mr. Laden. Motion carried 4 -3. (Pogalz, Brady and Root
voting nay.) Board members commented that even though no permit will be required,
they believe it is a good idea to have regulations in place and clarity as to what is
allowed.
Mr. Nelson made a MOTION to close the Public Hearing at 7:46 p.m. Motion was
supported by Mr. Hyden. Motion carried 6 -0.
Mr. Nelson made a MOTION to recommend approval of Amending the Zoning
Ordinance to clarify requirements for Home Occupations, and Residential
Storage/Parking. Motion was supported by Mr. Laden. Motion carried 4 -2. (Pogalz and
Brady voting nay.)
VI. DISCUSSION ITEMS
A. Comprehensive Plan Update
Mr. Bengtson gave the board an update that the plan was submitted to the Metropolitan
Council in August. Staff met with the Met Council to discuss questions and submitted
additional information to Met Council as requested.
B. Governor Declares "Community Planning Month"
Mr. Bengtson stated that the month of October is National Community Planning Month.
Included in the board member packets was a Proclamation signed by Governor Tim
Pawlenty declaring October as Community Planning Month in the State of MN.
VII. ADJOURNMENT
APPROVED MINUTES
