• <br />• <br />Setbacks: <br />The Zoning Ordinance requires that accessory structures be five feet from side property lines, <br />thirty feet from rear property lines, forty feet from collector roadways (Main Street), and be <br />placed no closer to the front property line than the main dwelling. The proposed structure would <br />easily exceed all of these requirements. <br />Building Code: <br />The foundation (pony wall) for the proposed structure has been partially constructed. The <br />Building Official has requested additional information from the applicant to prove that the pony <br />wall is constructed in a manner capable of handling the strain of a very large fabric structure. <br />This information will need to be submitted prior to the Building Department issuing a peimit for <br />the structure. Other infoimation and documentation may also be necessary and should be <br />discussed directly with the Building Official. <br />The Building Official has raised two concerns over the use and construction of this building. <br />First, the use as a `Riding Stable' means that public will be entering the facility and because of <br />the size of the structure it may need to have a fire sprinkler system. The second issue is the <br />construction materials used. Since the structure will be exposed to the elements, weather <br />resistant materials must be used. <br />Findings: <br />State law requires the following findings to be made in order to grant the approval of a variance. <br />Staff has completed the findings in regards to the submitted request. <br />FINDINGS <br />In considering all requests for Variance or appeal and in taking subsequent action, the <br />City shall make a finding of fact: <br />a. That the property in question cannot be put to a reasonable use if used <br />under conditions allowed by the official controls. <br />While the zoning ordinance requires an accessory structure for all rural <br />properties, the site already is developed in excess of the maximum accessory <br />structure area of 4,200 square feet and exactly the number of accessory <br />structures allowed on the site. <br />b. That the plight of the landowners is due to physical circumstances <br />unique to his property not created by the landowner. <br />The restriction of the number and area of accessory structures is directly <br />related to property size. The entire property, whether covered by water, <br />easement, or wetland is used to deteimine the number and area of accessory <br />structures. Therefore there is no physical circumstance unique to this <br />property. <br />
