area, contacts with senior citizens groups and the Minnesota Council for Independent <br />Living and other forms of advertising. The Owner shall also utilize the public housing <br />waiting lists maintained by the Metropolitan Council Housing and Redevelopment. <br />Authority and the Lino Lakes Housing and Redevelopment Authority. Finally, the <br />Owner shall also establish and maintain a separate waiting list for the Special Needs <br />Units. <br />4. Failure to Rent Special Needs Units to Disabled Individuals. <br />a. Documentation of Rental Activities. The Owner shall <br />contemporaneously document all attempts made to rent such Special Needs <br />Units to a Disabled Individual and the Owner shall certify in writing to the <br />META the reasonable steps that have been taken to rent the Special Needs <br />Units to Disabled Individuals at the time it applies for the issuance of I.R.S. <br />Forms 8609. <br />b. Rental to Non - Disabled Individuals. In the event the Owner <br />has been unable to rent all of the Special Needs Units within the time frame <br />set forth in Section VIC? and the Owner has complied with the <br />documentation requirements set forth in Section VI.C.4.a., the Owner may <br />rent any vacant Special Needs Units to tenants who do not include a Disabled <br />Individual. <br />c. Continued Classification as Special Needs Unit. In the event <br />a Special Needs Unit is rented to tenants who do not include a Disabled <br />Individual after the Owner has complied with the requirements of Section <br />VI.C.4.a. and b., such Special Needs Unit shall continue to be treated as in <br />compliance with this Restriction and eligible for the low- income housing tax <br />credits, (provided, however, that such tenants meet the income requirements <br />set forth in Section 42 of the Internal Revenue Code of 1986, as amended.) <br />5. Subsequent Vacancy. When a Special Needs Unit which has been <br />rented to tenants who do not include a Disabled Individual subsequently becomes <br />vacant, the Owner shall first be required to take all Reasonable Steps to rent that <br />Special Needs Unit to a Disabled Individual as set forth below. <br />D. Subsequent Vacancies. <br />1. Treatment of Vacant Special Needs Unit. When a Special Needs Unit <br />subsequently becomes vacant after Initial Occupancy, the Special Needs Unit shall <br />continue to be treated as a Special Needs Unit and in compliance with the <br />Restriction while vacant if Reasonable Steps are being made to rent the Special <br />Needs Unit to a Disabled Individual. <br />C -4 <br />
