vacate a Special Needs Unit and will have the option to move to a Project Unit which <br />is not a Special Needs Unit during the renewal term upon the receipt of thirty (30) <br />days written notice from the Owner in the event: <br />a. A vacant non - Special Needs Unit is available for occupancy at <br />the end of the thirty (30) day notice period; and <br />b. A Disabled Individual will be able to occupy the Special Needs <br />Unit at the end of the thirty (30) day notice period. <br />F. Change in Status of Disabled Individual. A unit shall continue to remain a <br />Special Needs Unit in compliance with the Restriction and eligible for the low- income <br />housing tax credit in the event a Disabled Individual no longer meets the definition of <br />Physically Disabled. <br />1. End of First Lease Term. The non - qualifying tenant (and any other <br />tenants of such Special Needs Unit) will be required to move to a Project unit which <br />is not a Special Needs Unit at the end of the applicable lease term, if the following <br />conditions are met: <br />a. A vacant non - Special Needs Unit is available for occupancy at <br />the end of such lease term; and <br />b. The Owner has contacted a Disabled Individual on its waiting <br />list and that Disabled Individual is able to occupy the Special Needs Unit at <br />the end of such lease term. <br />2. Renewal Leases. After the end of the first lease term, non - qualifying <br />tenants will be required under any renewal agreement to vacate a Special Needs Unit <br />and will have the option to move to a Project Unit which is not a Special Needs Unit <br />during the renewal term upon the receipt of thirty (30) days written notice from the <br />Owner in the event: <br />a. A vacant non - Special Needs Unit is available for occupancy at <br />the end of the thirty (30) day notice period; and <br />b. A Disabled Individual will be able to occupy the Special Needs <br />Unit at the end of the thirty (30) day notice period. <br />VII. OWNER CERTIFICATION OF RESTRICTIONS. <br />A. Issuance of the I.R.S. Forms 3609's. In connection with its application for the <br />issuance of the appropriate I.R.S.
