• <br />• <br />• <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 1D <br />Julie Bartell, City Clerk <br />October 25, 2010 <br />Consider Approving Application for Exempt <br />Permit from Lawful Gambling License (Raffle), St. <br />Joseph Catholic Church <br />Simple Majority (3/5 Vote) <br />St. Joseph Catholic Church has applied for an exempt permit to conduct a raffle to be <br />held on November 25, 2010. The proceeds from this fundraising event will be used to <br />award college scholarships to members of St. Joseph Catholic Church. Non - profit <br />organizations are allowed, under the State Gambling Statutes, to apply for an <br />exemption from a gambling license if they conduct five (5) or fewer gambling occasions <br />per calendar year. St. Joseph Catholic Church conducts five (5) or less per calendar <br />and, therefore, remains exempt from requiring a gambling license. <br />Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 does, however, require that <br />the non - profit organizations applying for the exemption permit notify the city that they <br />are applying for the exemption and that local approval be received. <br />The city is allowed to request a 30 day waiting period as part of its approval. However, <br />given the schedule for this event and the requirement to get the permit to the state for <br />review, staff requests that the council approve the request with no waiting period. <br />The application is on file in City Clerk's office. <br />OPTIONS: <br />1. Adopt a motion approving the application for exemption with no waiting period <br />2. Deny the application for exemption. <br />RECOMMENDATION: <br />Option No. 1 <br />
