• DANGEROUS ANIMAL HEARING <br />• <br />• <br />STAFF ORIGINATOR: Chief Kent Strege <br />HEARING DATE: November 22, 2010 <br />TOPIC: Dangerous Animal Disposition <br />Background <br />- November 8th a hearing was held where the city council upheld the declaration of <br />the Sawh's dog as a "Dangerous Animal ". <br />- The Sawh's were allowed to keep the dog if they followed stipulations determined <br />by the City Council. <br />- On November 9th officers of the Lino Lakes Police Department took a report of <br />the same dog biting another person at 1366 Wolf Circle at approximately noon <br />that day. <br />o Chris Hanson contacted the LLPD (Incident #10- 258649) and reported <br />that he went to 1366 Wolf Circle to deliver furniture. <br />o He went downstairs to see where the furniture was to be moved to. <br />o The dog came out of the unlocked kennel and bit him. <br />o The dog left puncture wounds on his left hand (photographs taken) <br />o He reported the incident after he spoke with his employer. <br />o Officers later responded to 1366 Wolf Circle and after confirming the <br />incident happened the dog was seized per ordinance and impounded at the <br />Otter Lake Animal Care Clinic (OLACC) where it has remained since. <br />On November 10th I spoke with the OLACC staff who advised me that since the <br />dog was already about 2.5 years old the behavior was not likely to change with <br />training. <br />I drafted and had delivered a letter that informed the Sawh's that their dog had <br />been declared dangerous on November 8th and had subsequently inflicted an <br />unprovoked bite and per city ordinance it shall be destroyed in a humane manner. <br />- The letter further stated that they have 14 days to appeal the order. <br />Attachments: <br />- City Ordinance regarding Potentially Dangerous and Dangerous Animals <br />Text of letter to the Sawh's regarding order for destruction of the dog <br />- Incident report 10- 258649 <br />Staff Recommendation: <br />The dog residing at 1366 Wolf Circle was declared a dangerous animal on <br />November 8th. The same animal inflicted an unprovoked bite on an invited visitor to 1366 <br />Wolf Circle. The city ordinance states the dog shall now be destroyed. Staff <br />recommendation is the ordinance be followed and the dog destroyed. <br />
