• <br />• <br />• <br />AGENDA ITEM 6.A. <br />STAFF ORIGINATOR: Paul Bengtson <br />CC MEETING DATE: December 20, 2010 <br />TOPIC: Resolution No. 10 -116: Approving a Conditional <br />Use Permit for a Veterinary Hospital at 6511 Ware <br />Road Suite 140 <br />BACKGROUND <br />Brian Hansen has requested a Conditional Use Permit to operate a veterinary <br />hospital at 6511 Ware Road Suite 140. Rice Creek Animal Hospital will occupy <br />an approximately 1,400 square foot tenant space within the Spirit Hills shopping <br />center. The site is zoned General Business and guided by the Comprehensive <br />Plan for Commercial development. A veterinary hospital is listed as a conditional <br />use within the General Business zoning district. <br />CONDITIONAL USE PERMIT REQUIREMENTS <br />The following requirements are listed within the GB (General Business) district in <br />regards to obtaining a Conditional Use Permit and operating a veterinary <br />hospital: <br />14. Veterinary Hospitals provided that: <br />a. All areas in which animals are confined are located indoors and are <br />properly soundproofed from adjacent properties. <br />The applicant has submitted a soundproofing plan that will be <br />enforced by the building department at time of building permit <br />and will be monitored for success. <br />b. Animal carcasses are properly disposed of in a manner not utilizing <br />on -site garbage facilities or incineration and the carcasses are <br />properly refrigerated during periods prior to disposal. <br />The applicant has submitted a disposal plan that will include <br />temporary holding in a freezer and pick up twice a week by a <br />reputable animal cremation service. <br />c. An indoor animal kennel is permitted as a use accessory to the <br />veterinary hospital provided that: <br />1) The number of animals boarded shall not exceed twenty (20). <br />2) An indoor exercise area shall be provided to accommodate <br />the periodic exercising of animals boarded at the kennel. No <br />outdoor exercising of animals shall be permitted. <br />-36- <br />
