• Council [Member <br />its adoption: introduced the following resolution and moved <br />• <br />• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 10-116 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A <br />VETERINARY HOSPITAL AT 6511 WARE ROAD SUITE 140. <br />WHEREAS, the City has received an application for a conditional use permit for a <br />veterinary hospital for property currently described to -wit: <br />Lot 1, Block 1 of Spirit Hills Center <br />; and <br />WHEREAS, at their meeting on December 8, 2010, the Planning & Zoning Board <br />conducted a public hearing and recommended approval of the conditional use <br />permit; and <br />WHEREAS, the proposed conditional use permits meets the requirements of the <br />City's zoning ordinance and subdivision ordinance subject to certain conditions of <br />approval. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes <br />hereby approves the conditional use permit based on the findings in the staff <br />report and subject to the following conditions of approval: <br />1. This approval is based on the submitted floor plan for Suite 140. Any <br />change to the location within the shopping center or enlargement of the <br />business would require an amendment of this conditional use permit. <br />2. This approval does not include approval of an indoor animal kennel, only <br />an area for keeping animals immediately prior to and after veterinary <br />service is provided. The addition of animal kenneling would require an <br />amendment of this conditional use permit. <br />3. The base conditions for the proposed use must be met at all times. The <br />base conditions for a Veterinary Hospital are: <br />a. All areas in which animals are confined are located indoors and are <br />properly soundproofed from adjacent properties. <br />b. Animal carcasses are properly disposed of in a manner not utilizing <br />on -site garbage facilities or incineration and the carcasses are <br />properly refrigerated during periods prior to disposal. <br />
