• Council [Member its adoption: introduced the following resolution and moved • • CITY OF LINO LAKES RESOLUTION NO. 10-116 RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A VETERINARY HOSPITAL AT 6511 WARE ROAD SUITE 140. WHEREAS, the City has received an application for a conditional use permit for a veterinary hospital for property currently described to -wit: Lot 1, Block 1 of Spirit Hills Center ; and WHEREAS, at their meeting on December 8, 2010, the Planning & Zoning Board conducted a public hearing and recommended approval of the conditional use permit; and WHEREAS, the proposed conditional use permits meets the requirements of the City's zoning ordinance and subdivision ordinance subject to certain conditions of approval. NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the conditional use permit based on the findings in the staff report and subject to the following conditions of approval: 1. This approval is based on the submitted floor plan for Suite 140. Any change to the location within the shopping center or enlargement of the business would require an amendment of this conditional use permit. 2. This approval does not include approval of an indoor animal kennel, only an area for keeping animals immediately prior to and after veterinary service is provided. The addition of animal kenneling would require an amendment of this conditional use permit. 3. The base conditions for the proposed use must be met at all times. The base conditions for a Veterinary Hospital are: a. All areas in which animals are confined are located indoors and are properly soundproofed from adjacent properties. b. Animal carcasses are properly disposed of in a manner not utilizing on -site garbage facilities or incineration and the carcasses are properly refrigerated during periods prior to disposal.
