Planning & Zoning Board <br />May 9, 2007 <br />Page 3 <br />APPROVED MINUTES <br />Mr. Nelson referred to Condition No. 12, and asked what would happen if the county <br />decided to allow a variance that the city did not agree with. Staff re plied that the county <br />will have their own requirements. Mr. Studens ki stated that the city could amend the <br />conditions of approval to address this. <br /> <br />Staff confirmed that the existing stoc kpile is currently 22 - 24 feet high. <br /> <br />Mr. Pogalz asked why the trips per day were reduced from 50 to 25 trips per day. Staff <br />said they had reduced the number in respons e to resident and Pl anning and Zoning Board <br />Member concerns. <br /> <br />Mr. Laden pointed out that the ordinance requ ires that an applicant specify a completion <br />date, and asked if a completion date had b een addressed. Mr. Studenski replied that <br />development is anticipated on the site in the n ear future and, due to the limited amount of <br />activity that will occur, staff had not request ed a specific completion date. Staff noted <br />that the board could recommend a deadline date, but that all CUPs ar e reviewed annually. <br /> <br />Applicant, Mike Black, Royal Oaks Realty, 1000 County Road E, Suite 150, Shoreview, <br />MN, reiterated that the zoning or dinance allows this use in an y zoning district. He stated <br />that conditions are required for a CUP in order to make the use compatible with <br />neighboring properties. Mr. Black descri bed that Royal Oaks Realty is a land <br />development company, Royal Excavating is thei r sister company, and Imperial Homes is <br />the home building company and they all work to gether. He explained the intent of their <br />request is to stockpile dirt fo r their own company and that dirt will not be sold to other <br />companies. He said they presume that some weeks there may be no trucks accessing the <br />site, and explained that they will access the stockpile when there is final grade work <br />being done. He noted that they never intende d to be hauling material in and out on a <br />daily basis, and only when there is a bigge r job would they possibly meet the maximum <br />trips per day. He thanked the board members th at were able to visit the site. He stated <br />that they have tried to meet a number of staff’s recommendations since the last P&Z <br />meeting, and they should not have a problem a dhering to staff’s conditions of approval. <br />He stated that he spoke with Randy Bettinger of Anoka County earlier that day regarding <br />the county review. He was told by Mr. Bett inger that the County is offering comments, <br />but not necessarily requirements. He said Mr. Bettinger stated that the county does not <br />require the road improvements. Mr. Black spoke of the possibility of moving the <br />entrance. He said he is concerned about the road recommendations, but added that Mr. <br />Bettinger told him that if the ci ty does not require this, then the county does not require it. <br />He would like an opportunity to discuss the county’s recommendations with city staff and <br />the county. <br /> <br />Mr. Nelson commented that he believes that the term grading means a one-time earth <br />moving. <br /> <br />Mr. Laden believes the intent of the ordinanc e is for a temporary use, and that a final <br />grading plan and a project completion date are required. <br /> <br />Mr. Black stated that the prope rty is guided for medium density residential and that they <br />hope to develop in two to five years or s ooner.
