Planning&Z oningBoard March8,2006 <br />Page 6 <br />APPROVEDMINUTES <br />Mr.Hilgerofferedthattheycouldeaseupthedegreeoftheturnoutofthedrivethrough <br />area.Hepointedoutthattheyhaveincludedadditionalopenspaceandlandscapingwith <br />thisplan. <br />M r.Rootreiteratedthatthisisanallowableuse,andtheboardisnotabletochooseusers. <br />Headdedthatthebuildingwasapprovedandisestablished,andreiteratedthatthetwo <br />itemsfortheCUParetheoutdoorseatinganddrive -through.Henotedthat helikesthe <br />outdoorseatingandfeelsitisagoodfeature.Hehasconcernswiththedrive -through <br />includingstriping,thedegreeoftheangletoexit,andgeneratingcartraffic <br />Mr.Rootaskedaboutthefutureparkingareaonthesouthsideofthebuildi ng.Mr. <br />Smyserstatedthatthisparkingareawouldbeforemployeesonly. <br />Mr.Rootwasconcernedaboutthelightingandsoundfromthemenuboard.Mr.Smyser <br />pointedoutthatthenearesttownhomeisalmostthreefeetaway,andthatthespeakeris <br />notlarg ethereforeshouldnotbeaudibletotheresidentialarea. <br />Mr.Rootaskediftheboardcouldseparatetheapprovalsfortheoutdoorseatingandthe <br />drive -through.Mr.Smyserrepliedthattheboardcouldseparatetheitems. <br />Mr.Smysernotedthattrafficwas studiedaspartoftheentireMiller’sCrossroadsproject. <br />Mr.Tralleexpressedconcernthatthedrive -throughwouldaddtraffictothetownhomes. <br />Mr.Hilgerpointedoutthattheoriginalproposalforplattingthesiteincludedfour <br />buildings,whichhave beenreducedtoonebuilding.HeaddedthattheCountyrequireda <br />rightturnonlyontoBirchSt.,regardlessoftheuser.Hecontinuedthatadrive -through has <br />thesameissuesofaccessasotherusers,andthattheyarenowproposingafractionof what <br />th eystartedwith. <br />Mr.Hydenwonderedifstudiesshowthatadrive -throughincreasesbusiness.Mr.Hilger <br />repliedthatstudiesdonebyITE,InternationalTrafficInstitute,shownodataoncoffee <br />shops,onlyfastfoodfacilities.Headdedthatthestudiessh owthatthebiggest <br />contributionadrive -throughprovidesisareductiononparking. <br />Mr.Hydenreiteratedthattheboardwillnotdeterminewhatuserscangointoaspace, <br />andtheyshouldfocusonthetwoissuesathand. <br />LindaFagerland,181EgretLane,askedhowtheboardcouldapproveacoffeeshopwith <br />oneacrossthestreetifthegasstationwasnotapprovedbecausetherewasoneacrossthe <br />street. <br />Mr.SmyserrepliedthatwhenMiller’sCrossroadswasoriginallyconside red,thezoning <br />wasnotyetdetermined.Heexplainedthatsincezoninghasnowbeendeterminedforthe <br />site,thecitycannotrefuseauseifitisallowedinthatzoneandmeetsrequirements.He <br />continuedthatthecityhasnolegalrighttorefuseacoffee shop.Headdedthattheyhave <br />nodatatoindicatethatadrive -throughwillincreasetraffic.
