Planning&ZoningBoard <br />April12,2006 <br />Page 2 <br />APPROVED MINUTES <br />A.CONTINUED PUBLICHE ARINGforaConditionalUsePermittoallowa <br />commercialdogkennelat7933 -24 th Avenue <br />Mr.Bengtson presentedthestaffreport. <br />Staffrecommendedapprovalsubjectto the fiveconditions listedinthestaffreport . <br />Chair Rafferty declaredthe continued PublicHearingopenat6:38p.m. <br />Boardmembersexpressedconcernforcurrentunsanitaryconditionsofthesitealongwith <br />runsthatdonotmeetstandards.Boardmembersagreedthatatthistime,thesiteisnot <br />compliantw iththeregulationsforakennellicense.CityStaffremindedtheboardthat <br />theyarevotingona conditionalusepermit fortheproperty,notakennellicense. <br />Mr.Bengtson reportedthatthepolicedepartmentwillinspectthesiteforcompliance <br />withth eordinanceinregardstoakennellicense .Mr.Bengtsonconfirmedthatthecity <br />couldrevokethe conditionalusepermit if aviolationofSection502oftheCityCode <br />occurs . <br />Boardmemberswereconcernedwiththeissuanceofacommercialuseversusapr ivate <br />use,notingthatacommercialuseisintendedforthesaleofdogs.Mr.Bengtsonnoted <br />thatthestandardsforaprivateorcommercialkennelarethesame ,butamaximumof <br />fourdogsareallowedwithaprivatekennel . <br />Boardmembersagreedthatthea nimalordinances houldberevised ,stating thatit lacks <br />standardsthatshouldbeinplacefortheprotectionofdogs. <br />Mr .Bengtson clarifiedthattheapplicanthassubmittedaseparateapplicationfora <br />commercialkennellicense and that th ePoliceDepar tment wouldhaveto inspectthesite <br />for licensing. <br />M r.Raffertyinvitedthepublictospeak.Noonewaspresenttospeakonthesubject. <br />Thea pplicantwasnotpresent. <br />Mr.Tralle madeamotiontoclosethePublicHearingat7:13p.m.andwassupported by <br />Nelson.Motioncarried 6 -0. <br />Mr.Raffertypointedoutadiscrepancyregardingthenumberofallowabledogsreferred <br />tointheapplicant’sletter.Mr.Bengtsonstatedthathecouldclarifythenumber being <br />requested withtheapplicant.Headdedthath eunderstandsthe applicantistryingto <br />complyinordertokeepallofherdogs ,andaprivatekennelallowsamaximumoffour <br />dogs .Mr.Bengtson stated thataccordingtotheapplicant,thesixthdogmentioned inthe <br />letter belongedtoarelative . <br />Mr.P ogalz pointedoutthatacommercialkennelwould allowforadogtohavepuppies, <br />buttheymustbegoneby sixmonthsof age.
