Planning&ZoningBoard <br />September13,2006 <br />Page 2 <br />APP ROVED MINUTES <br />A.PUBLICHEARINGfora Rezoning,MUSA Allocation,Varianceand <br />PreliminaryPlatfor GoldenAcre <br />Mr.Pogalz madeamotiontocontinuetheP ublicHearing to theOctober11 ,2006 <br />meeting.Motionwassupportedby Mr.Hyden .Motioncarried 5 -0. <br />B.PUB LICHEARINGfor aZoningOrdinanceAmendmenttomodifythe <br />allowableuseswithintheNB,NeighborhoodBusiness,andtheLB,Limited <br />Business,zoningdistrictsandforaRezonefromLB,LimitedBusiness,toNB, <br />NeighborhoodBusiness,atLot1,Block16,Mil lersCrossroads,locateda t the <br />southeastcornerofBirchSt.andHodgsonRd <br />Mr.Smyser clarifiedthataPublicHearing noticewaspublished forthisitem forthe next <br />CityCouncilmeeting which willincludeamendmentstotheGB,GeneralBusiness <br />District inadditiontotheNBandLBDistricts . <br />Mr.Smyserpresentedthestaffreport and explain ed thattheCityCouncil directedstaffto <br />rezonetheproperty .Examiningthedifferencesbetweenzoningdistrictsledtostaff <br />recommendationtochangesomeofthe usesallowedinthebusinesszones .Staff <br />requestedthattheboardtakeactionthisevening inorderfortheitemtogototheCity <br />Councilmeeting aspublished . <br />Mr.Tralle opened thePublicHearinga t6:59 p.m. <br />Mr.GregSchlink,BruggemanProperties,ownerof Lot1,Block16,MillersCrossroads , <br />gav eabriefhistoryofthesite .Mr.Schlink state d that thePlanning&Zoningboard <br />recommendedapprovalof ac offeehousewithadrive -through ,butt he CityCouncil was <br />preparedto denytherequest.Mr.Sc hlinkexplainedthattheywithdrewtheirapplication <br />insteadofreceivingadenial.Mr.Schlink distributedaletter,datedSeptember13,2006, <br />referredtoas MillersCrossroads ShoppingCenter(AgendaItemV.B.),to board <br />membersandcitystafftobeinc ludedas partofthepublicrecord.Mr.Schlink toldboard <br />membersthathe wasinformedt heissue wasa “donedeal,”thereforehehad no further <br />comments butwould answer any questions. <br />BoardMembersquestionedtheapplicantaboutthechangestothezoni ngordinanceas <br />presentedand asked ifthedrive -through wa stheapplicant’smainconcern.Mr.Schlink <br />statedthathethinksadrive -through useonalimitedbasisisreasonable forthissite, <br />addingthattheintentisforasmallc offeeshop.Hebelieve sthiswould notcausea <br />traf f icissueorbedetrimentalto theneig hborhood.Mr.Schlinkstatedthathismain <br />concernisthedrive -through.Headdedthattheydo wanttheabilitytoservebeerand <br />wine,provide outdoorseating,andhavethepotentialfo ra smallhospicefacility. <br />Mr.Raffertyaddressedthatstaffhasaddedoptionstothe N eighborhood B usiness district <br />asproposed ,andthattheCityCouncilwoulddenyadrive -throughatthislocation .Mr. <br />Schlink statedhe wouldliketheopportunityt opropose a drive -through againinthe <br />future,butarezonetothepropertywouldeliminatethatoption.
