Planning&ZoningBoard <br />December13,2006 <br />Page 2 <br />APPROVED MINUTES <br />A.CONTINUED PUB LICHEARINGfora PreliminaryPlatandVariancesfor <br />frontsetbackanduplandlotareaforFran’sEstate <br />Mr.Bengtson statedthatrevis edplanshadbeensubmitted ,andtherequestforfront <br />setbackwasremoved so thevariancerequestwasforuplandareaonly.Staff <br />recommendedapprovalofth e requestforuplandlotsizeandpreliminaryplatsubjectto <br />the eleven conditionslistedinthe staffreport. <br />Mr.Nelsonaskedifthe400ft.wetlandfillneededtobeacondition.Mr.Bengtsonsaid <br />thatstafffeltthatbecausethefillwasminimal ,aconditionforthisitemwasnot <br />necessary. <br />Mr.Pogalz askedabouttheconditionreferringto ane xistingsepticsyste mneeding tobe <br />abandoned onthe site.Mr.Bengtsonstatedthatth isisa standardrequirementofthe <br />ordinance,andthatthereis notnecessarily onein existenceonthissite. <br />Mr.Rootaskedifthe6%deviationwas considered mino rduetothelargesize ofthe <br />property .Mr.Bengtsonrepliedthatstaff didconsiderthe percentage tobe minorbecause <br />ofthesizeofthis property. <br />Mr.Pogalzaskedifthereisanystandingwaterinthisarea.Mr.Studenskirespondedthat <br />thewetland areadoesholdwaterforaminimaltime,butitisnotanissueandwillbea <br />citymaintenanceprocess. <br />Applicant,Mr.FranTourville,6948LakeDrive,s ai dthatheagreedwithallofthe <br />conditionslistedinthestaffreport.Mr.Tourvillecommentedth atRiceCreekWatershed <br />hasinformedhimthathecanfill400feetasanamendmentonhispermit. <br />Mr.NelsonaskedifMr.Tourvillehadconcernsiftheboardaddedthe400footfillasa <br />condition.Mr.Tourvillestatedthathedoesnothaveanyconcern sandwouldnot mind if <br />theyadded the condition. <br />Boardmembers concludedtoaddaconditionregardingthewetlandfill. <br />Mr.P ogalz madeaMOTIONto closethePublicHearingat6:49 p.m.Motionwas <br />secondedbyMr.L aden.Motioncarried4 -0. <br />Mr.Nelson madeaMOTIONtoapprovethePreliminaryPlatandVarianceforuplandlot <br />areaforFran’sEstatewiththefollowingconditions (Condition12wasaddedatthe <br />meeting): <br />1.Existingonsitesepticsystemswillbeappropriatelyabandoned. <br />2.Existingwellsshall becappedwhenrequiredbyMinnesotaDept.ofHealth <br />requirements. <br />3.IssuesdiscussedintheCityEngineerreviewmemomustbeaddressedtohis <br />satisfaction.
