• <br />• <br />Cavegn Estates Vacation, page 2 <br />Council Member moved for adoption of the following <br />ordinance: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 01 -06 <br />AN ORDINANCE VACATING LOIS LANE RIGHT -OF -WAY AND <br />STREET AND UTILITY EASEMENT <br />(CAVEGN ESTATES) <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1 Findings <br />The City Council makes the following findings regarding the application to vacate a portion of <br />public right -of -way and existing street and utility easements: <br />1. Anthony and Kimberly Cavegn, the owners of property adjacent to Lois Lane legally <br />described as Lot 1, Block 2 Mar Don Acres has requested the City Council to vacate an <br />unimproved cul -de -sac right of way and the drainage and utility easements as recorded on the <br />Mar Don Acres plat according to law. <br />2. A public hearing was held on February 13, 2006 before the City Council in the city hall on <br />such request after due published and posted notice had been given, as well as personal notice <br />to affected property owners by the clerk on January 24th 2006 and all persons interested were <br />given an opportunity to be heard; <br />3. The applicant is dedicating to the public, as part of the Final Plat for Cavegn Estates all <br />necessary drainage and utility easements; <br />4. It appears that it will be in the best interest of the city to approve such request <br />Section 2 <br />Such request is hereby granted and that part of Lois Lane lying southerly of the necessary 60 foot <br />right of way and the Drainage and Utility Easement platted on Lot 1 Block 2 of Mar Don Acres <br />described as follows are hereby vacated: <br />That part of Lois Lane as dedicated in the plat of MAR DON ACRES, Anoka County, <br />Minnesota, which is adjoining Lot 1, Block 2, said MAR DON ACRES; and which lies <br />south of a line beginning at the northwest corner of said Lot 1; thence East, assumed <br />bearing, along the north line of said Lot 1, 160.00 feet to a corner of said Lot 1; thence <br />
