MEETING DATE: March 13, 2006 <br />TOPIC: Resolution 06 -30 <br />Approving the Final Plat, Marshan Meadows <br />And Accepting a Conservation Easement <br />VOTE: 3/5 <br />BACKGROUND <br />The City Council approved the preliminary plat for Marshan Meadows on May 9, 2005 <br />with Resolution 05 -61. Marshan Meadows is a 20 -lot residential development on Lake <br />Drive. <br />The final plat is consistent with the approved preliminary plat. The City Attorney has <br />reviewed the title commitment. The City Engineer has prepared the development <br />agreement. <br />The approval of the preliminary plat included a condition for a conservation easement <br />along the lake. The proximity of a nesting area for a rare species, the Forsters' tern, <br />makes it important to protect the wetlands and the lake. This bird has been documented <br />as nesting in wetlands in the Marshan Lake area. The conservation easement coincides <br />with our standard drainage and utility easement over the wetlands that line the lake. The <br />easement prohibits such things as mowing and dumping of grass clippings or fill. There <br />will be signs along the easement edge so the homeowners know where it is. <br />OPTIONS <br />1. Approve Resolution 06 -30 approving the final plat for Marshan Meadows and <br />accepting the conservation easement. <br />2.
