• <br />AGENDA ITEM ? <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />MEETING DATE: March 27, 2006 <br />TOPIC: First Reading of Ordinance No. 03 -06 Repealing Drug Lab <br />Ordinance (No. 21 -01) <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND <br />On November 13, 2001, the Lino Lakes City Council adopted Ordinance No 21 -01, <br />adding language to the City Code regarding drug labs, declaring such sites to be <br />hazardous properties and further establishing abatement and assessment authority for <br />associated costs. <br />The City Administrator has now been advised by City Attorney Barry Sullivan that the <br />State of Minnesota has enacted a similar law that delegates responsibilities to county <br />governments. In light of this new law that supersedes local authority Mr. Sullivan has <br />suggested that it would be appropriate for the City of Lino Lakes to repeal its <br />ordinance so as to remove any conflict or confusion. A copy of the State law is <br />attached for your information. <br />Police Chief Pecchia has been informed of this recommendation and concurs with the <br />recommendation to repeal this ordinance. <br />RECOMMENDATION <br />Staff is recommending that the City Council approve First Reading of Ordinance 03 -06 <br />Repealing Ordinance No. 21 -01. <br />ATTACHMENTS <br />1. Correspondence from City Attorney recommending repeal of the City's drug <br />lab ordinance; <br />2. Minnesota Statutes, Section 152.0275; <br />3. Ordinance No 21 -01, the language to be repealed. <br />
