HawkLawl@aol.com <br />A few years ago, the City adopted a comprehensive meth lab ordinance which <br />declared these sites to be hazardous properties, ordered the abatement of these <br />nuisances and authorized the City to assess costs for clean up. <br />The 2005 Minnesota legislature followed the lead of Lino Lakes and other cities and <br />adopted a very similar State statute. See Minn. Stat. §152.0275 (2005). Under the <br />State statute, the authority and burden for cleaning up meth labs has been delegated <br />to the county, local health department, or sheriff, which now have the responsibility <br />of posting these sites, ordering clean up, and following through with abatement. This <br />State statute supersedes local ordinance and I believe it is appropriate for the City <br />Council to repeal our clandestine lab ordinance so as to remove any conflict or <br />confusion.
