He stated a temporary cul-de-sac had a <br />connotation to it. He stated the wordi ng temporary meant it would go through at some <br />point. <br />Mr. Corson made an amendment to his MOTION to delete the words “temporary cul-de- <br />sac” and add the words “a turn around on the new section of Carl Street as identified in <br />the developer’s plan”. <br />Motion carried 4-1-1 (Mr. Lyden – Nay. Mr. Tralle – Abstained). <br />Chair Schaps recessed the meeting at 8:40 p.m. and reconvened at 8:51 p.m. <br />C.CONTINUED PUBLIC HEARING, ATS&R, Living Waters Lutheran <br />Church, 865 Birch Street, Site Plan Review and Conditional Use Permit <br />Chair Schaps reopened the P ublic Hearing at 8:52 p.m. <br />Staff stated ATS&R has submitted an application on behalf of Living Waters Lutheran <br />Church for CUP/Site and Building Plan Re view for the property located at 865 Birch <br />Street (PID# 28-31-22-32-0019). The appli cant is requesting to construct a building <br />addition to accommodate a new sanctuary. The application indica tes that the subject <br />property consists of approximately 9.34 acres . The site is zoned R-1 Single Family <br />Residential. Religious institutions are a conditional use within R-1 Single Family <br />Residential District. The si te abuts CSAH 10 to the south, Country Lakes Estates (R-1 <br />Single Family Residential) to the west, Re shanau Lake to the North and residential <br />property zoned R-1, Single Family Residential to the east. <br />Staff presented its analysis by noting the following: <br />Site and Building Plan Review <br />Property Legal Description. The subject property has a metes and bounds legal <br />description within Section 28, Township 31 North, Range 22 West (PID# 28-31-22-32- <br />0019) and contains 9.34 acres more or less. <br />Project Schedule. The application contemplates bidding will commence during the <br />Winter of 2003 with substantial completi on of the building addition by Fall 2003. The <br />proposed schedule is in acco rdance with the requirements set forth in Section 2, Subd. <br />5.E.2 of the Ordinance. <br />Zoning/Use. The subject property is zoned R-1 Si ngle Family Residential. Religious <br />institutions are a permitted conditional use within the R-1, Single Family Residential <br />District provided that: <br />(a) side yards shall not be less than fifty (50) feet;
