Planning & Zoning Board <br />February 12, 2003 APPROVED MINUTES <br />Page 35 <br />Conditional Use Permit <br />As previously indicated, the applicant is requesting approv al of a conditional use permit <br />to allow an accessory drive-through-facility for the retail center. While the accessory <br />drive-through associated with the motor fuel station (the carwash) will be required at <br />some future point, it is not being considered at this time as detailed plans regarding the <br />motor fuel station have not been received. <br />The retail center drive-through lane is loca ted on the north side of the building and is <br />configured to provide ample stacking sp ace (for eight vehicles) and minimize site <br />disruptions. <br />In considering conditional use permit requests, the Ordinance states that the Planning and <br />Zoning Board shall recommend approval and th e City Council shall order the issuance of <br />such permit only if it finds that such use at such location: <br />1.Will not be detrimental to or endange r the public health, safety, comfort, <br />convenience or general welfare of the neighborhood or the City. <br />Comment: Drive-thru facilities currently ex ist within the City of Lino Lakes. The <br />proposed use in not anticipated to be detrimental or endanger the public. <br />2.Will be harmonious with the general and applicable specific plans and policies <br />of the comprehensive plan of the City and this ordinance. <br />Comment: The Comprehensive Plan suggests commercial use of the site. Thus, <br />the proposed land use sati sfies the land use directives of the Plan. <br />3.Will be designed, constructed, operated, and maintained so as to be harmonious <br />and appropriate in appearance with the ex isting and/or intended character of <br />the general vicinity and will not change the essential character of that area. <br />Comment: The building design is consistent with the requirements of the <br />Ordinance and therefore will not change the character of the area. <br />4.Will be served adequately by essential pu blic facilities and services, including <br />street, police and fire protection, drainage structures, refuse disposal, water and <br />sewer systems, and schools; or will be served adequately by such facilities and <br />services provided by the persons or ag encies responsible for the establishment <br />of the proposed use. <br />Comment: As a condition of project appr oval, the building wi ll be adequately <br />served by essential public facilities and services. <br />5.Will not create excessive additional requirements at public cost for public <br />facilities and services and will not be de trimental to the economic welfare of the <br />community.
