• <br />• <br />• <br />BE IT FURTHER RESOLVED that the following conditions of approval apply: <br />1. A performance agreement shall be prepared, and recorded against the property, as <br />required for site and building plan reviews per Sec. 2, Subd. 6.E.4. <br />2. Water and sanitary sewer utilities must be constructed across this site in accordance <br />with the Millers Crossroads utility plan approval. An easement must be granted to <br />the City for these utilities prior to any site work beginning or permits being issued. <br />3. The easement across Outlot G, Millers Crossroads 3rd Addition for the drive through <br />driveway shall be fully reviewed and approved by City staff prior to any site work <br />beginning or permits being issued. <br />4. An engineered retaining wall plan and cross section of the wall and the street for the <br />drive through must be supplied and obtain City Engineer approval prior to any site <br />work beginning or permits being issued. <br />5. Responsibility for maintaining the retaining wall, roadway, and related facilities for <br />the drive through shall be the responsibility of the owner of Lot 16, Block 1, Millers <br />Crossroads and this shall be ensured through a maintenance agreement, which shall <br />be recorded against the property. This agreement must be executed prior to any site <br />work beginning and before a building permit is issued. <br />6. Approval of the conditional use permit includes the approval of a parking deferment. <br />The 84 parking spaces shall be constructed as shown on the plans. If the City fmds <br />that the additional stalls are necessary to accommodate the use, the City may require <br />that additional parking be constructed, as shown on the plan as "proof of parking ". <br />This also would require moving the trash enclosure. Additional requirements may be <br />imposed. The performance agreement shall require the property owner install such <br />parking if directed by the City. This performance agreement must be executed and <br />financial securities received by the City before a building permit is issued. <br />7. All signage must comply with the revised signage plan for the project and the City's <br />sign ordinance. Sheets A4.1 and Figure 4 on sheet SP2 are to be considered part of <br />the revised signage plan. <br />8. The lighting fixtures for the south wall must be 90 degree cutoff fixtures so they cast <br />light downward, not upward. New fixtures must be submitted and compliance with <br />this condition verified prior to issuance of a building permit. <br />9. The parking lot lights must be 90 degree cutoff design, as submitted (Medallion CM <br />flat lens). The two driveway lights may be the decorative fixtures (Towne Commons <br />ALN 445) that echo the street lights in the Millers Crossroads residential area. <br />10. Parking lot and driveway lights shall be no taller than street lights in Lakota Trail (18' <br />above finished grade). <br />- 71 - <br />Resolution 06 -53, page 2 <br />
