• <br />• <br />• <br />MEMORANDUM <br />W S ITEM #9 <br />April 26, 2006 <br />To: City Council <br />From: Jeff Smyser c <br />Subject: Millers Crossroads Shopping Center Conditional Use Permit <br />At the April 24 meeting, the City Council tabled consideration of Resolution 06 -53, the <br />CUP for outdoor seating and a drive through. The Council decided to discuss it further at <br />the work session on May 1. Please bring your staff report from the April 24 meeting, as <br />the report includes the relevant information. <br />In summary, a CUP was granted in 2003 for a daycare business. The new CUP <br />application is for a drive through and outdoor seating. A CUP requires Council approval, <br />which is the only reason the City Council is reviewing the project. The businesses in the <br />building are permitted uses and the building would be an administrative review. <br />Both a daycare and a coffee shop offer services that will be used by early morning and <br />evening commuters. Parents will drop off children before work and pick them up after <br />work. Commuters will use a coffee shop on the way to work and after work. Of course, <br />both types of business will be open all day. The April 24 staff report includes analyses of <br />traffic generation and parking. <br />The Council discussion included the question of additional screening. We learned that <br />the townhome property is owned by the residents' homeowners association: it is no <br />longer under the developer's ownership or control. Staff has not had the opportunity to <br />confer with the developer regarding screening as of the date of this memo. <br />A CUP for the outdoor seating and drive through would be granted to the property. <br />Future businesses could use the drive through if the coffee shop leaves. A fast food <br />restaurant would require additional parking under the zoning requirements, which would <br />be a restriction because of the finite area of the site. <br />
