WORK SESSION MEMORANDUM <br />To: Mayor and City Council <br />From: Michael Grochala <br />Date: May 1, 2006 <br />Re: Work Session Item 5 — Pomp's Tire <br />Background <br />d kic1 a'1,k S c c i wr <br />2o©,6 <br />WS -5 <br />On April 24, 2006 residents adjacent to the Pomp's Tire site attended the city <br />council work session to present their concerns regarding construction activities <br />and possible nonconformance with City ordinance requirements. The City <br />Council directed residents to meet with City staff and the City Attorney to discuss <br />the issues. The council also requested that the issue be placed on the May 1, <br />2006 City Council Work Session agenda. <br />Development Process <br />In September of 2004 the Rice Creek Watershed District (RCWD) issued a <br />conditional approval (CAPROC) for a rough grading plan, wetland alteration plan, <br />and stormwater management plan for Lot G (Pomp's Tire Site) within Apollo <br />Business Center (Permit Application No. 04 -100). The approval included the <br />alteration of an existing wetland to create a stormwater quality pond to serve the <br />future development of the site as well as a new 27,626 square foot replacement <br />wetland on the northern portion of the site. <br />In November of 2006 the City received a Conditional Use Permit application from <br />Pomp's Tire for a 30,870 square foot tire warehouse and tire installation facility. <br />Automobile and Truck Repair is a conditional use within the LI, Light Industry <br />Zoning District. The application was scheduled for a public hearing and review <br />by the Planning & Zoning Board for December 14, 2006. Additionally the Rice <br />Creek Watershed District issued a conditional approval (CAPROC) for the Final <br />Site Drainage Plan (Permit Application No. 05 -117) which included the <br />replacement wetland identified in their previous approval. <br />The required Public Hearing was held on the December 14, 2006. Public <br />testimony was received from Mr. John Freimuth, 7381 Jon Avenue. The <br />Planning & Zoning Board recommended approval of the CUP with 10 conditions <br />Page 1 <br />
