use abuts property zoned for residential use or where a business or <br />industrial use is across the street from a residential zone. <br />Screening may take the form of either a "green belt planting strip" of not <br />less than 80% opacity with a minimum height of six (6) feet or a fence with <br />a minimum of height of six (6) feet. Earth mounding or a berm may be <br />used to accomplish part of the minimum height requirement. <br />Pomp's Tire originally submitted a landscaping plan that included an <br />earthen berm and landscaping along the southern 2/3 of the site adjacent <br />to Jon Avenue. The Planning and Zoning Board recommendations <br />included a condition requesting a revised landscaping plan that provided <br />screening along the west and north property lines of the site that conforms <br />to the City requirements. A revised landscaping plan was submitted to the <br />City and included in the City Council report for the project. Staff met with <br />Pomp's Tire representatives on Thursday, April 271h to further review the <br />proposed landscaping and discuss neighborhood concerns. In response, <br />Pomp's is revising the landscaping plan to include additional plant <br />materials. Ultimately, the proposed screening will be evaluated by staff, <br />following installation, to insure conformance with city requirements. <br />3. Inconsistency with Approved Plans. Residents have expressed concerns <br />that the construction activities don't conform to the plans approved by the <br />City and that the plans substantially changed from what was originally <br />presented to the Planning and Zoning Board and neighboring property <br />owners. These concerns are based, in part on the removal of trees and <br />the extensive pond and wetland replacement excavation on the site. Staff <br />has reviewed the application materials, and RCWD review for the project. <br />The plans are consistent with what was originally proposed. As stated <br />previously, a replacement wetland was originally proposed for the <br />northwest corner of the site which dictated the removal of trees. The <br />landscaping plan has been modified to address issues raised by the <br />Planning and Zoning Board and conformance with the Zoning Ordinance <br />requirements. <br />The only departure from the original submittal and the approved plans is <br />the expansion of the stormwater quality pond to the south of its proposed <br />location. The City engineering department received a received a request <br />for expansion of the ponding area on April 13, 2006. Engineering is still <br />completing review of the request, however, on April 24, 2006 staff <br />became aware that construction of the proposed pond expansion had <br />taken place. While this is a departure from the approved plans the <br />expansion does not impact the screening /landscaping proposed, building <br />location, or parking lot/drive lane improvements. The only city regulatory <br />issue with the pond expansion is to insure that all storm water design <br />criteria are being adhered to. <br />Page 3 <br />
