In 2003 the City re -zoned the <br />property to Limited Business, approved my client's proposed PUD plan under Resolution No. <br />03 -142, and granted a CUP permitting the use of the property as a day care center under <br />Resolution No. 03 -143. Following those approvals, however, my client's plans changed and it <br />did not construct the shopping center as approved. <br />My client is now ready to proceed with developing the shopping center, with a minor <br />modification. Instead of the day care center, my client now desires to lease space in the <br />shopping center to a coffee shop tenant. To accommodate the potential coffee shop tenant, my <br />client needs to add an accessory drive - through and an outdoor seating area. <br />Under the Limited Business zoning district, both of those uses require a conditional use <br />permit. Accordingly, my client requested a CUP permitting it to build a drive - through and <br />seating area. On March 8, 2006, the Planning and Zoning Board approved the CUP that my <br />client requested. City staff then recommended, in a staff memo by Jeff Smyser April 24, 2006, <br />that the City Council approve the requested CUP because the proposed project meets the <br />requirements for granting the CUP. <br />The CUP request was on the City Council agenda for Monday, May 8, 2006.
