• <br />• <br />• <br />MEMORANDUM <br />July 5, 2006 <br />To: <br />From: <br />Subject: <br />WORK SESSION ITEM #2 <br />City Council <br />Jeff Smyser <br />Millers Crossroads Shopping Center Conditional Use Permit For <br />Drive Through Facility and Outdoor Seating <br />This application involves a conditional use permit (CUP) for a drive through facility and <br />outdoor seating, both for a proposed coffee shop. At the June 12 meeting, the city <br />council tabled this application at the request of the applicant. Discussion centered on the <br />drive through facility. <br />The applicant has submitted a sketch showing a revised layout for the site. The new <br />layout eliminates the additional driveway and redirects the drive through traffic around <br />the building. This avoids creating a new driveway offset from the intersection of two <br />public streets. <br />The applicant offered to include a deed restriction that would limit use of the drive <br />through to a coffee shop. This would prevent other future uses such as a fast food <br />restaurant from using the drive up window if the coffee shop leaves. The city attorney <br />suggests an alternative of simply adding a condition of approval for the CUP that would <br />create this limitation. The condition also could limit the size of the coffee shop. <br />At the June 12 meeting, the city council tabled the application upon agreement from the <br />applicant to extend the review period for 60 days. This extension expires August 16, <br />which means the city council must act either on July 24 or August 14. <br />
